The terms and conditions set forth herein (the "Terms of Use" or "Terms") govern your use of the Homeowner Companion application (the "App"), which is owned by and made available by The Companion Group, LLC ("The Companion Group," "we," "us," or "our"). These Terms of Use constitute a legally binding agreement between us and you regarding the terms on which we offer you access to the App.
Your use of the App is governed by these Terms. Please take a few minutes to review the Terms and our Privacy Policy. By accessing and using the App, you agree to be bound by each of the Terms and all applicable laws and regulations governing the App. If you do not agree with any of the Terms, you are not authorized to access or use the App for any purpose.
We reserve the right to modify these Terms at any time without giving you prior notice. We will do so by posting updated Terms on our website. Your use of the App following any such modification constitutes your agreement to follow and be bound by the Terms of Use as modified.
You may use the App solely for your personal, non-commercial use as set forth in these Terms.
You agree not to alter, modify, reformat, copy, download, reproduce, reverse engineer, duplicate, display, distribute, repost, transmit, publish, license, sell, rent, transfer, or create derivative works from the App, except as expressly permitted by the Terms of Use. This includes using the App to train or otherwise enhance any artificial intelligence products or models. Moreover, you may not use any of the marks appearing on the App without express written consent from the trademark owner unless they are embedded in the Content available for use, or except as otherwise permitted by applicable law.
You understand and agree that you are responsible for maintaining the privacy and security of information uploaded to the App. All of the information that you upload to our App is stored locally on your device. The Companion Group does not gather, store, maintain, or have any access to the information you upload to the App. There is no central server holding your data. This means:
The App, including its code, design, text, graphics, and trademarks, is owned by The Companion Group and protected by U.S. and international laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. All rights not expressly granted are reserved.
The App is offered for use in the United States only. By using the App, you confirm that you are located in the United States and only will use the App for information about individuals located in the United States. The App is not offered to, and is not intended for use by, individuals located outside the United States.
In some instances, your wireless provider may charge you in connection with your use of the App on your mobile device. This may include fees for data transmission. These fees are not charged by us. We are not responsible for any such fees you may incur. If you downloaded the App from the Apple App Store or Google Play, the applicable store terms also apply.
You are solely responsible for any information you transmit to third parties via email or text messaging, regardless of whether you use the App to facilitate such third-party messaging or not. We have no control over what you do or do not send to third parties.
The Companion Group may, from time to time and in its sole discretion, develop and provide updates, upgrades, patches, bug fixes, or new versions of the App, and may add, modify, or remove features or functionality, with or without notice to you. You acknowledge that (a) the App may not function on all devices or operating systems; (b) you are solely responsible for ensuring your device meets any minimum system requirements; and (c) The Companion Group may discontinue the App, in whole or in part, at any time without liability. We may be available to provide technical assistance specific to the App but do not guarantee such availability. We have no ability or responsibility to resolve device-specific issues.
The App is available to install from homeownercompanion.app. Full use is unlocked either with a code (for example, provided through a partner organization's membership) or with a one-time purchase. The unlock is a one-time payment only — there is no subscription, no recurring fee, and no automatic renewal. Payments are processed by Stripe. For direct purchases through our website, write to us within 30 days of purchase and we'll process a refund through Stripe. For purchases made through a partner organization's membership, contact that organization.
We may suspend or terminate your right to access the App at any time if you violate these Terms or if we discontinue the App.
YOU EXPRESSLY AGREE TO ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE APP. WE MAKE NO EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS, OR ENDORSEMENTS WHATSOEVER WITH RESPECT TO THE APP. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT, WITH REGARD TO THE APP OR ANY INFORMATION OR CONTENT CONTAINED THEREIN (INCLUDING THIRD PARTY INFORMATION). WE SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING EITHER DIRECTLY OR INDIRECTLY FROM ANY USE OF THE APP OR ANY INFORMATION OR CONTENT CONTAINED THEREIN (INCLUDING THIRD PARTY INFORMATION). IT IS SOLELY YOUR RESPONSIBILITY TO EVALUATE THE ACCURACY, COMPLETENESS AND USEFULNESS OF ANY INFORMATION OR CONTENT PROVIDED BY THE APP. WE DO NOT WARRANT THAT THE FUNCTIONS PERFORMED BY THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT DEFECTS IN THE APP WILL BE CORRECTED. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY INFORMATION OR CONTENT PROVIDED BY OR AVAILABLE ON THE APP OR THAT ANY ERRORS IN THE INFORMATION OR CONTENT WILL BE CORRECTED. THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
IF YOU ARE DISSATISFIED WITH THE APP OR WITH THE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE APP. YOU ACKNOWLEDGE, BY YOUR USE OF THE APP, THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK. YOU UNDERSTAND AND AGREE THAT UNDER NO CIRCUMSTANCES WILL WE BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, OR ANY OTHER MATTER RELATING TO THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH STATES, OUR LIABILITY IS LIMITED AND WARRANTIES ARE EXCLUDED TO THE GREATEST EXTENT PERMITTED BY LAW.
You agree to indemnify, defend and hold harmless The Companion Group, our subsidiaries, affiliated companies, joint venturers, business partners, licensors, employees, and agents from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys' fees, resulting from or arising out of your use of the App, any violation by you of this Agreement, or any activity related to your use of the App (including negligent or wrongful conduct) by you or any other person accessing the App through your use of the App.
